Marnys general sales terms and conditions
1. OBJECTIVE
The present General Terms and Conditions intends to regulate the relationship between MARNYS –Martinez Nieto, S.A. (hereunder “MARNYS”) and you (hereunder “customer”), related to underlying transactions through the website www.marnys.com (hereunder “the web”), internet domain whose owner is Martinez Nieto, S.A.- legally set company, located in Pol. Ind. Los Camachos Sur – Av. del Carbono 44, parcela 96, 30369 – Los Camachos / Cartagena (SPAIN), with CIF A30603757 and registration in the Commercial Registry of Murcia, in the 16 book, 3ª section, 31 sheet, piece of paper 266.

Online products offered by MARNYS through this website shall be subject to the General Conditions.
The order implies the acceptance of the general sales conditions.
2. PRICES AND PRODUCTS
2.1. Prices
The sales prices of the online products on Marnys.com, are indicated in euros, and will be the ones that appear on the website at the moment at the moment of your purchase and once your order will be effective. MARNYS reserves the right to modify the prices of its products at any point in time. In that case, the new prices will be applied to new orders, and to any modification that the customer request related to old orders. This means that any price changes will be applied to orders in progress.
Indirect taxes are included in the prices on the date of the order, but not in the shipping cost. The shipping cost will be charged to the customer and added to the total quantity of the chosen products. You will be informed before you pay and complete the recruitment process.
2.2. Product characteristics
The customer can collect, before placing the order, any necessary information on MARNYS’ website, about the basic characteristics of the product or products that would like to order.
The customer can choose and purchase one or several products among different categories that MARNYS’ website offers.
MARNYS shows the basic characteristics of the products (description, how to use, ingredients, additional information, and price).
MARNYS’ products have their legal warranty as per current legislation.
Martínez Nieto, S.A. – MARNYS maintains its commitment to the environment and therefore complies with the German VerpackG Packaging recovery and recycling regulation that entered into force on 1st January 2019, ensuring the recycling and reuse of packaging and transport material, the control of waste management and reducing the production of greenhouse gases.
3. THE ORDER
All orders imply the full acceptance of the restrictions and the present general sales conditions.
All orders paid online are not processed until they are validated by the banking institution.
MARNYS will inform you through your e-mail address about your shipment status.
Order confirmation: we have received your order correctly, where the order details, items selected, shipping costs, number of order, and the procedure for the withdrawal right are collected.
Expedition confirmation: your shipment has left our warehouse.
Shipment confirmation: your shipment has been given to the freight forwarder.
MARNYS recommends its customers to keep the details sent in the order information.
The shipment is expedited every working day at 17:00 p.m. from Region of Murcia (Spain). Orders placed before 13:30 p.m. hrs will be prepared and send on the same day. Orders placed after mentioned timeframe will be prepared and send on the following day.
4. SHIPMENT ACCEPTANCE
The acceptance and confirmation of the shipment will be done through the entry of data in different pages/ successive stages:

- Cart validation.
- Add address + Delivery option.
- Payment method.
- Acceptance of general sales conditions.
Until the step “make a payment”, you can change your shipment. Click on the icon “my cart” in the upper right corner.
Definitive acceptance has done in the moment of validation of the payment type.
5. PRODUCTS AVAILABILITY
MARNYS strives to have all products available on the website; notwithstanding, cannot guarantee that all products you wish to buy will be available by the time you are going to make the payment.
If during the preparation of the order a product is unavailable, you will be notified and another product with similar characteristics may be suggested, in which case you can cancel or change the initial order or accept or reject the new MARNYS offer.
6. THE PAYMENT
The payment has to be done just when the purchase has been completed by the customer. The customer counts on the following payment methods:
Payment with credit card
MARNYS accepts VISA and MASTER CARD.
When choosing secure payment, the customer will be directed to secure payment gateway of the Redsys Company which integrates the SSL safety standards.
The confidential payment information details are transmitted directly and in encrypted form to the relevant bank and are not stored by MARNYS.
Payment with foreign cards can be limited depending on the country.
Paypal / Paypal:
When selecting “confirm order”, the customer will be directed to PAYPAL payment site where must proceed to its identification or registry to make the secure payment. The customer will receive a confirmation of the payment. The customer will not be charged any additional costs neither commissions for using this payment method. Cash on delivery (only available within Spanish territory):
Cash on delivery allows you to pay your order when you receive it at home: you can validate your order in our website when choosing the payment method “cash on delivery” and pay for it to the carrier.
Bank transfer:
In favor of “Martinez Nieto, S.A.” the transference should be done within 7 calendar days from the moment the order is placed. In case we have not received transfer confirmation, the order will be canceled. Bank details will be shown once the order is completed. Note to mention the order reference in the concept of the bank transfer.
7. FIGHT AGAINST CREDIT CARDS FRAUD
The appearance of a non-payment due to the fraudulent use of a credit card, will make all data related to the order be recorded on the basis of a file of incidences of payment made by REDSYS.
Any irregularity or anomaly may receive a specific treatment.
MARNYS can check personal data provided by the client and apply the necessary measures (claim for supporting documents or cancellation of the order) in the event of detecting anomalies or receiving complaints from third parties.
MARNYS includes the 3D Secure payment system (also called Verified by VISA/Mastercard). It is a payment system validated by authentication that allows you to increase the security of your online purchases. When placing the order, your bank verifies the identity of the cardholder before validating the transaction. Once you have completed the information for your VISA or MASTERCARD, you will be redirected to the website of your bank where you will be asked for identification.
This way of proceeding is governed by each bank, they can, for example, ask you to enter a number received by SMS or enter the code of a card, etc. Once we have received confirmation of this step, your payment will be validated and you will receive the order confirmation email.

8. DELIVERY AND SHIPPING COSTS
The invoice will be sent to the customer along with the order.
MARNYS offers the following delivery methods:
Deliveries to Spanish territory:
Home delivery
The delivery of your order will be made by an external transport company (SEUR or MRW). Home delivery costs will be 4.00€ (free of charge for orders over 60.00€), and the delivery time will be 24/48 hours.
The carrier will make two delivery attempts. In case of absence, the customer or recipient will receive a notice of arrival in his mailbox, with the necessary information to retrieve your order.
Orders will not be delivered to P.O. boxes. Except in exceptional cases, we do not send via postal MAIL.
If you want to receive your package at another address, please notify us during the purchase process.
Shipments to the Canary Islands:
Orders received for delivery to the Canary Islands will be sent from our warehouse in Las Palmas. The prices shown on our website are final when shipping to the Canary Islands, except for shipping costs, which are charged at the end of the order.
Invoices issued to the Canary Islands do not include VAT, but the current state tax, IGIC or General Indirect Canarian Tax, which is levied on deliveries of goods and services, is applied. This tax is already included in the final price shown on the products on our website.
Shipping costs to the Canary Islands are 6 Euros (Taxes included) and free of charge from 60 Euros.
Currently, due to logistical reasons, we do not ship to Ceuta or Melilla. We are working to be able to offer this service in the near future.
Deliveries Outside Spanish territory:
MARNYS products are sold and delivered in all countries outside Spanish territory, within the European Union and outside the European Union, with the exception of the following countries:
You can choose between two options, as long as it is available for your country
- Express delivery with UPS (available for all countries): shipments will be delivered within 2-3 business days, by urgent orders.
- Traditional ground shipping (available for EU countries only): shipments will be delivered within 3-7 business days, by traditional ground shipping.
The delivery period described shall be effective in the event that the customer is located at the place of delivery during that period, in which case the products shall be deemed delivered on the date on which MARNYS makes them available at the place of delivery.
*Refrigerated shipment
Pure Royal Jelly is a product preserved under refrigerated conditions and sent through special transport just to Spanish peninsular provinces. We do not ship using refrigerated transport to countries other than Spain.
Customs Information (Non-EU Member Countries)
Please take into account that our products are formulated and labelled in compliance with European standards and regulations.
If your shipping address is outside of the European Union, it may be subject to customs duties and other taxes that accrue once the items arrive in the destination country from which they have been ordered through Marnys.com.
Any additional costs due to the payment of customs and/or tariff duties will be borne by the customer. MARNYS has no control over these charges and cannot predict the nature or amount of them.
Customs policies vary significantly from country to country, so the customer should contact the local customs office for more information. Please also remember that when you place an order through Marnys.com, you will be considered the importer of the items and must, therefore, comply with all applicable laws and regulations in the country in which you are receiving the items. Generally, customs models for international orders will list the value of the contents of your order by product type.
MARNYS will not receive returned packages that could not be delivered for customs reasons. Packages retained in Customs without the possibility of being delivered for reasons beyond the control of MARNYS, will be declared abandoned, without the possibility, therefore, of proceeding to the total or partial refund of the payment made by the same.
Your privacy is very important for us and we know that you are worried about the way in which we use your shipment information. Notwithstanding, we would like to inform you that international business is subject to inspections and revisions by customs authorities from each country. Maybe we have to provide some information about the product to our transportation agent. Likewise, it is possible that our information should be given to the authorities for legal compliance.
Our customers’ privacy is important to us and we understand that you may be concerned about how your order information is used. However, you should be aware that international trade is subject to inspections and reviews carried out by the relevant customs authorities. In certain circumstances, MARNYS is obliged to provide its transport agents with certain information concerning the products they transport. It is also possible that such information may have to be transferred to the relevant authorities in order to facilitate compliance with the legislation.
In order for the import process of your products to run smoothly and without any inconvenience, we recommend that you contact the customs office of your country or region to be informed, before placing your orders, about the import restrictions that apply to some products.
9. REFUNDS
Rights of withdrawal and refund
In accordance with current legislation, the customer has a period of 14 calendar days from the date of receipt of the products, to exercise the right of withdrawal on the order.
To exercise the right of withdrawal within this period, the customer must notify MARNYS in writing (MARNYS – Martínez Nieto, S.A.). – Pol. Ind. Los Camachos Sur – Av. del Carbono, 96, 30369, Los Camachos / Cartagena (SPAIN), telephone: 968 515 080; fax: 968 534 300; e-mail: , providing your name, home address, telephone number, fax number, and e-mail address), your decision to withdraw from the contract of sale through an unequivocal statement (for example, a letter sent by post, fax or e-mail). You can use the model withdrawal form that you can find here below, although it is not mandatory.
In the event of withdrawal on your part, we will refund all payments received from you, including delivery charges.
For orders delivered in Spain, returns are always free of charge. MARNYS will bear the cost of returning the order. MARNYS will send to your home a parcel agency that will return the package to us.
For orders delivered in other countries outside Spain, the direct cost of returning the product must be borne by the customer. The returned item must be sent to the following address: MARNYS – Martínez Nieto, S.A. – Pol. Los Camachos Sur – Av. del Carbono, 96, 30369, Los Camachos / Cartagena (SPAIN). You must return the product in perfect condition, unused and in its original packaging.
The refund of the purchase will be carried out to the reception of the items in Martínez Nieto, S.A., after checking its state.
We will refund using the same payment method used in the initial transaction (except cash on delivery) unless you have expressly provided otherwise; in any event, you will incur no expense as a result of the refund.
Please note that when paying by credit card, your bank may not show you the amount of the refund in your balance until the following month.
If you pay cash on delivery, once we will have received the shipment we will refund to you by bank transference in the number of accounts that you give it to us. You should give us the bank number by mail.
If you pay cash on delivery, once we have received your package with the returned item(s), we will refund by bank transfer to the provided account number, within 14 days of receiving the item(s). You must provide the bank account details by e-mail.
Return of defective product or not in conformity with the order.
In this change process, we advise you to add a photo of the product unpackaged in which we can notice the damage or defect. Once we have checked the information from the custom, we will deliver the same product requested by the custom and ratify the new order. In this case, you do not have to pay the delivery cost. The cost will pay by MARNYS.
In these cases, it is advisable to attach a photograph of the unpacked item in which the deterioration or defect of the item can be perceived. Once the information sent by the customer through written notification has been validated by MARNYS, the same product will be supplied in substitution of the one requested by the consumer and the new shipment will be validated. In this case, the customer will not have to pay the shipping costs of the new order. The direct costs of return will be borne by MARNYS.
10. COMPETENT JURISDICTION
The present Sales Conditions are based on Spanish law. The contract will be understood to have been entered in the place where the customer has the habitual residence, and the courts and tribunals of that place will be competent to hear any dispute arising from these Sales Conditions.
The European Commission also provides an online extra-judicial dispute resolution platform that is available at https://webgate.ec.europa.eu/odr, and through which consumers can submit their claims.
